Product Ban
- Thermometers, thermostats, medical and scientific measuring devices, and novelties. Does not apply to products with button cell battery. Manufacturers can apply for a five year exemption.
- Switches and relays except if regulated under the Federal Food, Drug, and Cosmetic Act, or if inside a thermostat
- Mercury-added zinc-air button cell batteries
Manufacturer Collection/Recycle
- Mercury-Switch Thermostats - Beginning Jan 1, 2011, each manufacturer must, individually or collectively with other manufacturers, establish a system to collect, transport, and properly manage out-of-service mercury thermostats and make collection bins available to wholesalers, qualified contractors, retailers, and qualified local government authorities. The program requires approval by the IL EPA, must contain outreach and education activities, and will be subject to collection goals specified in the law and established through stakeholder process for later years. If the goals are not met, thermostat manufacturers must submit proposed revisions to the program to IL EPA for review and approval. The Agency may require manufacturers to provide a $5 financial incentive to contractors and consumers if deemed necessary to achieve the collection goals.
- The Mercury Thermostat Collection Act was amended in 2015 to ensure that loose mercury ampuoles received in collection boxes would count towards annual collection goals, and to require thermostats obtained through demolition projects to be recycled
