Code Alert: New York, 12 January 2010

The New York State Department of State, Division of Code Enforcement and Administration announced that proposals to update the Uniform Fire Prevention and Building Code and State Energy Conservation Construction Code will be published in the January 13, 2010 edition of the New York State Register. This begins the public comment period, which will end on March 15, 2010. The Department will hold public hearings throughout the State, where interested parties can comment on the proposals. Public comments can also be submitted to: Raymond Andrews, R.A., Department of State, Division of Code Enforcement and Administration, 99 Washington Ave., Suite 1160, Albany, NY 12231-0001. Comments received during this period will be presented for final consideration by the State Fire Prevention and Building Code Council at its April 1, 2010 meeting. The proposals are based upon provisions of the 2006 editions of the International Residential Code, International Building Code, International Plumbing Code, International Mechanical Code, International Fuel Gas Code, International Fire Code, International Property Maintenance Code, International Existing Building Code and the 2009 edition of the International Energy Conservation Code. New York State modifications have been integrated with provisions of the International Codes to create the 2010 editions of the Codes of New York State.

Modifications affecting the electrical industry are as follows. The 2006 International Building Code and the 2006 International Existing Building Code have been modified to reference the 2008 National Electrical Code. The 2006 International Residential Code, Part VIII – Electrical Provisions has been replaced with Part VIII of the 2009 International Residential Code. Part VIII - Electrical Provisions is a compilation of provisions extracted from the National Electrical Code® (NEC®), which is produced and copyrighted by the National Fire Protection Association (NFPA). Part VIII of the 2006 IRC edition was based upon the 2005 NEC and the 2009 IRC edition is based upon the 2008 NEC. An additional New York State modification adds a new section 3301.2.1 to Chapter 33 of the IRC, which is titled “Compliance” and states that compliance shall be demonstrated by either meeting the requirements of Part VIII of the IRC or meeting the requirements of the 2008 National Electrical Code.
