South Dakota Electrical Commission - Notice of Public Hearing to Adopt Rules

A public hearing will be held in Room 412, 4th floor, State Capitol, Pierre, South Dakota, on May 4, 2017, at 10:00 a.m., to consider the adoption and amendment of proposed rules numbered 20:44:14:01, 20:44:16:08, 20:44:16:09, 20:44:16:24, 20:44:19:01, 20:44:19:03, 20:44:19:05, 20:44:19:07, 20:44:20:10, 20:44:22:02 to 20:44:22:05, inclusive, 20:44:22:07,  20:44:22:12,  20:44:22:24, 20:44:22:27, 20:44:22:28, 20:44:24:01, 20:44:24:04, 20:44:24:05, and 20:44:24:06.

The effect of the rules will be to adopt the 2017 National Electrical Code (the "2017 NEC") and update the reference to the 2015 International Building Code (the "2015 IBC"); update definitions; document the requirement to hold a license to gain experience; clarify  that a federal employee is considered licensed; clarify a statutory reference regarding units of time for experience; change the expiration of maintenance licenses to occur in two years on the date of issuance; document notice requirements, document the available options an inspector may utilize at the stages of rough in, final, and the completion of corrections including, final void, issue a report or order a disconnect; clarify the minimum fee for an inspection man hour or fraction thereof; document the utilization of the term electrical equipment and the designation of machinery; update references to the National Electrical Code; require in use covers and a receptacle within 25 feet of the heating and ac equipment in residential housing units moved to new locations; and clarify the fee, notification and payment requirements and the inspection process for carnivals and celebrations.

The reasons for adopting the proposed rules are to adopt the 2017 NEC and update the reference to the 2015 IBC; define terms; clarify reference; regulate installations; document the process for administering licenses, permits and inspections; and to practically safeguard persons and property from hazards arising from the use of electricity.

Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Electrical Commission (the "Commission"), 308 South Pierre St., Pierre, South Dakota 57501.  Material sent by mail must reach the South Dakota Electrical Commission by May 3, 2017, to be considered.

After the hearing, the board will consider all written and oral comments it receives on the proposed rules.  The board may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
